NOTICE OF CERTIFICATION- Annexation Petition

ANNEXATION PETITION-NOTICE OF PUBLIC CERTIFICATION
On May 24, 2023, a petition proposing the annexation of real property located at approximately at the SW corner of 3900 West and 1225 North, and encompassing approximately 41.70 acres, was filed by Jon Ashdown. The area proposed for annexation in the petition is described as follows and shown on the attached map: BEGINNING AT THE WEST QUARTER CORNER OF SECTION 6, TOWNSHIP 36 SOUTH, RANGE 11 WEST, SALT LAKE BASE AND MERIDIAN;THENCE SOUTH 88°47'03" WEST 1,325.54 FEET ALONG THE CENTER EAST-WEST LINE SECTION 1, TOWNSHIP 36 SOUTH, RANGE 12 WEST, S.L.B.&M.;THENCE NORTH 00°11'29" WEST 342.57 FEET;THENCE NORTH 88°47'03" EAST 1,325.49 FEET TO THE WEST LINE SAID SECTION 6;THENCE NORTH 89°56'02" EAST 3,978.12 FEET TO THE EAST 1/16TH LINE SAID SECTION 6;THENCE SOUTH 00°00'21" EAST 342.57 FEET ALONG SAID EAST 1/16TH LINE TO THE CENTER LINE SAID SECTION 6;THENCE SOUTH 89°56'02" WEST 3,976.96 FEET ALONG SAID CENTER LINE SECTION 6 TO THE POINT OF BEGINNING.CONTAINING 1,816,585 SQUARE FEET OR 41.70 ACRES.
1. On May 24, 2023, a petition proposing the annexation of real property located at approximately the SW corner of 3900 West and 1225 North, and encompassing approximately 41.70 acres, was filed by Jon Ashdown.
2. On September 13, 2023, the Cedar City Council accepted the Petition to be further considered and authorized the Petition to be certified by City Staff.
3. On October 3, 2023, City Staff certified that the Petition meets the requirements of Utah State Law and notice was provided to the Cedar City Council, the contact sponsor, and the Iron County Commission.
4. The complete Annexation Petition is available for inspection and copying at the Cedar City Recorder’s Office, 10 North Main Street, Cedar City, Utah, Monday through Friday, during the hours of 8:00 a.m. and 5:00 p.m.
5. Cedar City may grant the Petition and annex the above-described area unless a written lawful protest to the Annexation Petition is filed with the Iron County Clerk, PO Box 429, Parowan Utah, 84761 c/o Jon Whittaker, or delivered to the Iron County Clerk’s Office located at 68 South 100 East, Parowan, Utah, 84761. A copy of the protest must also be delivered to the Cedar City Recorder at the address noted above on the same date that the protest is filed with the Iron County Clerk. Any protest must be filed as herein stated by no later than November 2, 2023, by 5:00 p.m.
6. If no lawful protests are received, the Cedar City Planning Commission will hold a public hearing on Tuesday, November 7, 2023, at 5:15 p.m. in the Cedar City Council Chambers located at 10 North Main Street, Cedar City, Utah, to consider a request to annex this property.
7. If no lawful protests are received, the Cedar City Council will hold a public hearing on Wednesday, November 15, 2023, at 5:30 p.m. in the Cedar City Council Chambers located at 10 North Main Street, Cedar City, Utah, to consider the request to annex this property.
8. The area proposed for annexation to Cedar City will also automatically be annexed to have Cedar City provide fire protection, and emergency services or law enforcement services, as applicable.
9. The area proposed for annexation to Cedar City will be automatically withdrawn from Iron County providing fire protection, and emergency services or law enforcement services, as applicable.

NOTICE OF ORDINANCES 

Notice is hereby given that the Cedar City Council at its regular meeting of September 27, 2023, passed the following ordinance(s):

  1. Ordinance No. 0927-23 – An Ordinance amending the amended plat of lot 11A of Ashdown Forest PUD Phase 6 by splitting lot 11A into the original lots 11 and 17; and
  2. Ordinance No. 0927-23-1 – An Ordinance amending the final plat of Carmel Canyon Subdivision Phase 1 by creating lot 9A by combining lots 9 & 10.

Said Ordinances shall become effective immediately upon posting on the State of Utah Public Notice Website.

A Copy of said ordinance(s) may be seen and/or purchased at the office of the Cedar City Recorder, 10 North Main Street, Cedar City, Utah.


NOTICE OF PUBLIC HEARING

PUBLIC NOTICE IS HEREBY GIVEN that on September 27, 2023, the Mayor and City Council of Cedar City (the “Issuer”), adopted a resolution (the “Resolution”) declaring its intention to issue its Parity Water Revenue Bonds (the “Bonds”) pursuant to the Utah Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended and to call a public hearing to receive input from the public with respect to the issuance of the Bonds. 

The Issuer shall hold a public hearing on October 25, 2023, at the hour of 5:30 p.m.  The location of the public hearing is in the City Office, 10 North Main Street, Cedar City, Utah.  The purpose of the meeting is to receive input from the public with respect to the issuance of the Bonds and any potential economic impact to the private sector for purchase or reimburse Issuer for funds used to purchase water rights and construction of culinary water system improvements, including but not limited to water rights, transmission and distribution lines, water tank, pumps and well houses, together with all related work and improvements (the AProject@) to be funded by the Bonds.  All members of the public are invited to attend and participate.
